Court Programs and Services Division is part of the Office of the State Court Administrator. The division is charged with developing, implementing, and evaluating court programs. As part of that effort, the Division assists courts with Appropriate Dispute Resolution (ADR) programs including mediation in domestic relations, juvenile dependency, civil, small claims, FED (eviction), and probate cases. The division provides education, guidance, training and technical assistance to judicial districts, judges, staff, local ADR/mediation commissions, state and local family law advisory committees, and various governmental and private agencies regarding ADR/mediation and family and juvenile law issues.

In addition to the ADR efforts, the division also provides assistance to courts on family and juvenile law issues, integrated treatment courts, and judicial and staff education. The division is also responsible for OJD strategic planning, collection and evaluation of statistics on a statewide basis, and performing high level liaison work to develop policies, procedures, and laws affecting court operations statewide. The division manages the development of Judicial Department policies and the Department’s external ADA compliance. The division also manages the Citizen Review Board and Certified Court Interpreter programs. Division staff oversee research and evaluation of innovative programs; provide assistance to local courts and committees; and provide training, technical assistance, consultation and support to local courts.

Approach to Practice / Form of Mediation

Every court provides publicly-funded mediation in domestic relations cases in which the custody or parenting time of a minor child is in dispute. Existence of small claims, FED (eviction), civil, probate, and dependency mediation varies by court. Small claims and FED (eviction) mediation is typically done by volunteers or court staff, often in cooperation with the local community dispute resolution center.

Court-connected mediators are required to meet the qualifications set forth in Uniform Trial Court Rule Chapter 12.
