Approach to Practice / Form of Mediation
|
|
I recognize that with ever-increasing costs, lengthy delays, limited judicial resources, and the loss of control of the outcome by submitting an issue to a judge or jury, mediation is superior to risks and costs of litigation. Alternative dispute resolution (ADR) including mediation and arbitration, is the preferred road to expedient resolution unless money is simply no object. I tend toward a directive and evaluative approach to mediation, based upon my extensive experience as a settlement commissioner and pro tem judge, where expedience is often a principal consideration. I do not spend a lot of time handholding, and have a demonstrated proficiency in cutting to the chase and getting the proverbial horns quickly into the sand.
