Approach to Practice / Form of Mediation

Most important--the mediator is a neutral party no matter what style he or she uses, no matter what the case. My role as mediator: 1. listen 2. understand 3. help my clients expand their range of possible solutions. As a widely published writer I offer expertise in careful wording and structuring of agreements. Mediators have different opinions about the value of their own expertise. Many feel they do not need to have any special knowledge of the subjects about which clients disagree. Some even feel this is best. I believe that my personal work in the areas in which I mediate, enables me to listen better to what my clients say. Better understanding leads to better mediating. Because mediation is voluntary and both parties must agree, the first agreement is on what form of mediation is acceptable to my clients. Each case calls for its own arrangements. In general, where the conflict arises from personal contacts, whether in a family or business, I like to mediate with all parties present. At the other end of the spectrum, mortgage renegotiation or reconciliation can take place on line. Other cases are best served by "shuttle mediation". Bottom line: clients choose the form of mediation. I'm glad to describe the possibilities and even willing to change the arrangements when the clients agree on a new format.

Background

When I was employed to interview hundreds of new entrepreneurs after the fall of communism in Eastern Europe, I discovered my history in many kinds of work gave me an advantage over colleagues who had spent their lives as economists or sociologists or bankers. I could walk into a business or onto a factory floor and understand what I saw and heard. I found this also serves well in mediation. Areas I've worked in professionally: construction, real estate brokerage, land development, running environmental groups, journalism, farming (both organic and non-organic), teaching in community college, high school, university, and courses for working professionals. I have served as resident adviser on housing and land reform in Central Asia, trained journalists there, observed elections in Latin America, Kazakhstan, Russia, and Croatia. I have served as a cross cultural trainer for foreign groups studying American business and government.

Fee Information

Initial phone consultation: no fee
Two party short meeting to explore mediation potential: $50
Mediation fees: $75 per hour for small and local mediations (2 party, within 1 hr drive time). $125 and up for cases requiring pre-mediation case development and more than 1/2 day; fees depending on the nature of the case.
Facilitation/group meetings: $400 and up
